Boxer & Gerson, LLP Partner Gary Lee joined a panel discussion at the State Building in Oakland on January 24 that included representatives from the state’s Department of Workers’ Compensation, its Occupational Safety & Health Administration (CAL-OSHA), the event sponsor Worksafe, and other stakeholders in the workers’ comp community. Worksafe is an Oakland-based nonprofit dedicated to promoting safe workplaces and serving as a resource for workers in the aftermath of an injury.
Lee focused his remarks on the efficacy of Labor Code 132a as a remedy for discriminatory treatment of injury-reporting workers and witnesses to the events. Labor Code 132a was enacted to protect employees from retaliation by employers when employees file a workers’ compensation claim after a workplace injury, but the law has a number of provisions which have required interpretations and clarifications by the courts over the years.
