The Social Security Process

Most initial Social Security Disability claims are rejected. But if you have not been successful, you should not give up hope. There are several points in the process that allow you to appeal a denied claim. The Social Security process is as follows:

Initial claim — The claimant files this claim with the Social Security Administration (SSA).

Request for Reconsideration — The claimant asks SSA to reconsider the initial rejection. Again, most requests for reconsideration are rejected. At this point, Boxer & Gerson, LLP can intervene and take action on your behalf.

Social Security hearing — Our firm can request a hearing before an administrative law judge. At the hearing, we can present additional medical evidence which documents your inability to work and try to overcome any objections on the part of SSA. Boxer & Gerson, LLP obtains approved claims in a large percentage of cases at this stage. Of course, the likelihood of success in any given case depends on the facts of that case and how they are affected by all applicable rules and regulations.

Social Security appeal — We can appeal your case to the SSA Appeals Council if appropriate and mutually agreed to.

Civil court appeal — If the Appeals Council rejects your appeal, Boxer & Gerson, LLP can take your case to federal district court if appropriate and mutually agreed to.
