Senior Litigation partner John Anton settled a case while on defendant’s appeal for $500K after an earlier favorable jury verdict in Contra Costa County. The case involved a delivery driver delivering a hospital bed to the Winsor Convalescent and Rehabilitation facility in Concord. Our client injured his foot and Achilles tendon when he stepped into a previously damaged grate that had gone unrepaired. The case hinged in part on a phone camera picture taken of the damaged grate by our client immediately after the injury. This confirmed the damage and the date and was critical when a defendant argued that there was "no record" of the delivery having been made on the day in question.
